CONSENT, RELEASE AND WAIVER OF LIABILITY FORM FOR PARTICIPATION IN THE BIG BASS GUIDE SERVICES SUMMER CAMP

 

PLEASE READ COMPLETELY AND CAREFULLY BEFORE SIGNING

I grant permission for my child or children (Please Print) to participate in the Big Bass Guide Services Summer Camp (hereinafter referred to as the "Camp"). I understand that it is my responsibility to provide transportation for my child(ren) to and from the Camp. I understand that to participate in this program, my child(ren) must abide by the established rules and codes of conduct established by the program staff. Good behavior is to be expected and The Camp reserves the right to dismiss a child from the Camp due to that child's disruption of the program, including but not limited to verbal and physical aggression against staff or other participants, failure to follow safety or program instructions, and any other disruptive behavior. A child's dismissal will be at the discretion of the Director (Captain Shea Arnold) of the Camp. If a child is dismissed from camp, there will be no refund. If a child is unable to swim, I understand it is my responsibility to inform Camp staff.

I understand and agree to assume any and all risks associated with the Camp's activities. I grant permission for my child(ren) to participate in activities that are part of the scheduled activities for the Camp. I grant permission for my child(ren) to be photographed for purposes of publicity. I understand that some photographs may appear in local and/or online publications or future Camp brochures. If any illness, injury, or accident occurs which, in the sole judgment of the staff of the Camp, requires immediate medical attention, I give consent for any member of the Camp staff to obtain such emergency treatment. I further consent to the signing of any releases by program staff, which may be required by any medical care provider. I understand that in the event of an emergency medical situation’s I will be notified as soon as possible. I also agree to provide the Camp staff with emergency contact numbers. I further understand that the cost of any medical care deemed necessary for the treatment of any emergency illness, injury, or accident occurring while my child is attending the Camp is my responsibility, and that the Camp and employees are not obligated to pay for such medical care.

The Camp has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19, and variants (“COVID”), at the Camp. However, The Camp cannot guarantee that your child will not become infected with COVID. Further, attending a Camp session could increase your child’s risk of contracting COVID. By signing the agreement, I acknowledge the contagious nature of COVID, and I assume the risk that my child, myself, and other family members may be exposed to or infected by COVID by attending the Camp and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I understand that the risk of becoming exposed to or infected by COVID at the Camp may result from actions, omissions, or negligence of myself, my child, and others, including, but not limited to, Camp employees, volunteers, other participants, and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injuries to my child, myself, and other family members (including, but not limited to, personal injury, disability or death), illnesses, damages, losses, claims, liability, costs or expenses, of any kind (collectively, “Claims”), that child and our family may experience or incur in connection with my child’s attendance at the Camp. On my behalf, and on behalf of my child, I hereby release, covenant not to sue, discharge, and hold harmless the Camp, its employees, volunteers, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions or negligence of the Camp, its employees, volunteers, agents, and representatives, whether a COVID infection occurs before, during or after participation in a Camp session.

Bad Weather Policy:

The Camp will aim to meet rain or shine but, in the instance of a thunderstorm, high winds and/or lightning during, or prior to, any outdoor Camp sessions, the Camp does reserve the right to cancel a session if the conditions are unsuitable and/or dangerous to be on or around the water. If the forecast on the day of a given session clearly calls for inclement weather before the start of a Camp session, the Camp programs might be cancelled in advance of a Camp session starting. Determinations whether to cancel any session(s) will be made no more than two hours BEFORE a session starts and will be based on state and/or county recommendations. Weather cancelation notices will be sent via email and/or text message. There are no refunds or prorates for Camp days that are cancelled, but the Camp will make every effort to reschedule days that are missed due to weather cancellations.

Cancellations:

If your child is unable to attend the Camp session for which you registered, please inform us as soon as possible. If you notify us at least 21 days before the first day of the Camp, we will issue you a full refund for the cost of the Camp, less the credit card processing fees we encountered, if any. If you provide at least 7 days’ notice, we will attempt to rebook the Camp session later in the summer schedule. If we are unsuccessful, we will provide you with a credit valid for one year which you may use on future Camp Session. If we are not able to rebook the camp session or if you provide less than 7 days’ notice, we regret that no refund will be issued. If your child is a “no show” for a Camp session(s), the day(s) will not be rescheduled, and no refund will be issued.

For the sole consideration of Big Bass Guide Services Summer Camp allowing my child to participate in this program, I hereby release and forever discharge the Camp and Salt Strong, LLC located at 1505 Lake Shipp Drive, Winter Haven, Florida 33880, from any and all claims, demands, rights and causes of action of whatever kind that I may have either arising from or by reason of any personal injury or property damage resulting from or in any way connected with my child's participation in this program. I further covenant and agree that for the consideration stated above I will not sue Big Bass Guide Service Summer Camp, Big Bass Guide Services, Salt Strong, LLC, or any of the camp employees. I have received a copy of this document and I certify I am at least 18 years of age and that I have read the above carefully before signing.
